Unclear Definitions
Legal document preparers must be ever vigilant to avoid even the appearance of engaging in the unauthorized practice of law. Sometimes the definitions are so unclear that it is all too easy to accidentally step over the line. Some states have clear and straightforward guidelines, other states are in the murky gray netherworld of maybe, maybe not, and it depends.
We believe that consumers' right to legal access is all important. And any laws, rules, or systems, that make life more difficult for consumers merit scrutiny.
The American Bar Association surveyed the state bar associations about their UPL laws and enforcement practices. It's fascinating reading. Published in May of 2012, it is titled, "ABA Standing Committee on Client Protection".
